TAMIL NADU SHOP AND ESTABLISHMENT ACT REGULATIONS

The Tamil Nadu Shop and Establishment Act lists the following major principles:

  • Preventing Child Labor No youngster is permitted to work in any establishment, as per the Tamil Nadu Shop and Establishment Act. A person under the age of 14 is referred to as a “child” in this context. In addition, young people can only work in establishments after 6 am or 7 pm. A young person can work 42 hours per week and seven hours each day. A person younger than 17 but not a child is referred to as a “young person” in this context.

  • Time of Opening and Closing Employees are only needed to work up to 48 hours per week and eight hours per day, and if they do, they should be paid overtime. In addition, any worker at a business or shop is entitled to a weekly day off.

  • Safety and health-related rules: According to the Tamil Nadu Shop and Establishment Act, every shop and establishment in the state is required to abide by certain health and safety regulations:

    • Cleanliness: Each establishment’s grounds should be clean and devoid of effluvia from drains, urinals, and other annoyances. Plans should be in place to regularly clean the establishments.
    • Lighting: During business hours, any establishment’s premises should have adequate illumination.
    • Ventilation: Every building’s ground should have a suitable ventilation system.
    • Protection from Fire Every establishment is required to adopt fire safety procedures.

Vacations: After delivering services for 12 months, anyone working in any business or shop is entitled to 12 paid holidays the following year.

Wages: Employers are required to provide compensation to the people they have hired. Every employer is required to set a deadline for when such payments are to be paid. Wage payment intervals may be more than a month.
